keep-WP:SOFIXIT The text says public domain after 15 years counted from the end of the calendar year in which they were first published. The photo was certainly published no later than one of two dates-1933 and 1947, as a serving head of state and active Scout addressing the world's foremost Scout event. If we count the more likely 1933, then 1948 is the PD mark. If we count 1947, after which all internal history of Scouting in Hungary was suppressed, but continued in exile, then 1962 is the target PD date. Even if we give it a later date, 1956 or 1990, as the next periods of openness, that still leaves us with 1971 or 2005 as the target date. By any standard, according to extant Hungarian law, this image is PD.--Kintetsubuffalo (talk) 11:54, 8 September 2012 (UTC)
I don't know which template should be used for this file. {{PD-Hungary}} says "70 years after the author's death"; {{PD-EU-no author disclosure}} says "published more than 70 years ago without a public claim of authorship (anonymous or pseudonymous)". See also commons:Commons:Copyright_rules_by_territory#Hungary, where it also mentions 70 years. The same term is mentioned in the templates listed in hu:Wikipédia:Képek licenceinek megadása (I don't know Hungarian; I used Google Translate to read this page). With an unknown author, we must have some proof of a publication date to assert that it's PD using one of these templates. You mention a term of 15 years, but I can't find such a term in the current Hungarian copyright law. Maybe such a term existed in a previous law, but we need to see the text of that law to ensure that this image qualifies under those conditions. Razvan Socol (talk) 04:43, 10 September 2012 (UTC)
See WP:Non-U.S. copyrights. For the United States copyright status, what matters is not the copyright status for the moment, but the copyright status in 1996. It says that on 1 January 1996, Hungary had a 50 years p.m.a. term for authors who died before 1944. There is no information about any specific copyright terms for photos and all links are dead, so there is no way to verify the information. If the photographer died immediately after taking the photo, the photo would be PD-old-50 on 1 January 1996, which would be enough. The copyright might also have expired as an anonymous work; I don't know what the former anonymous term was. --Stefan2 (talk) 09:11, 10 September 2012 (UTC)
The Three-point test says: "Is the work still under copyright in the source country? YES: The work can only be used on Wikipedia under the doctrine of fair use." Therefore, the current copyright status (in the source country) also matters (so the picture would be PD if the the author died in 1941 or earlier). Razvan Socol (talk) 17:40, 10 September 2012 (UTC)

I see. Regarding the 15-years term mentioned by Kintetsubuffalo above, I found the text of Act No. III of 1969 on Copyright (as last amended by Act No. LXXII of 1994) (which was in force until September 1999) which says:
"Art. 51.– (1) Photographs, figures, technical drawings, maps, graphic illustrations or aids and films which do not enjoy copyright protection as scientific or artistic works shall nevertheless enjoy protection if they bear the name of the maker and the year of publication or disclosure. (2) The duration of protection shall be 15 years from the end of the year of publication or disclosure. [...]"
If we can claim that this photo is not an artistic work, we only need to find out the date of publication (and it would have to be before 1981 to claim that the photo is now in the public domain in the United States). So from what I can see:
  • Image taken in 1933.
  • If published, it entered the public domain in Hungary 15 years after publication. This looks like the kind of thing which would usually be published in a newspaper shortly after taking the photo, but it would really be good to have some evidence of this.
  • If it was published somewhere without complying with United States copyright formalities (copyright notice, copyright renewal, copyright registration), it also entered the public domain in the United States. I assume that no Hungarian newspapers submitted copyright renewal registrations to the United States Copyright Office.
  • If it was published somewhere before 1981, it was also in the public domain in Hungary in 1996, meaning that the copyright couldn't be restored in the United States.
If all of the above "if" statements are true, then the image is in the public domain in the United States as {{PD-URAA}}. However, it seems that the copyright was restored in Hungary in 1999 and the image might still be copyrighted in Hungary, so it might not be suitable for Commons. About the artistic part, note that similar templates such as {{PD-Italy}} and {{PD-Sweden}} also requires that a photo be simple, but it is usually taken for granted that almost all photos are simple. --Stefan2 (talk) 21:44, 12 September 2012 (UTC)

I tried to find some evidence that the image was published at the time of the jamboree, but was unable to find it in the photo albums online here. I think it might be a still captured from an old newsreel, but it was not present in the copies of Baden-Powell's newsreels available on YouTube (reel one; reel two; reel three). Since we can't prove a publication date that places it in the public domain, I think we will have to convert it to fair-use for use in at least some of the articles were it is currently present. -- Dianna (talk) 03:05, 3 October 2012 (UTC)

  • Another {{PD-HHOFFMANN}} without National Archives link. Overwritten by a completely different photo, but both seem to be photos taken by H. Hoffmann. Stefan2 (talk) 18:31, 5 September 2012 (UTC)

The ones that were listed at PUF have now all been examined. None of them whatsoever were found at the National Archives as seized Nazi property, so we have to assume they are still under copyright. -- Dianna (talk) 03:37, 6 October 2012 (UTC)

  • According to Funk art the painting dates to 1958-1964, not pre-1923 which is the default claim for the license tag. I'm not seeing any other reason that it could be PD either. Besides that, the addition of a person in front of the painting means it's not a "mere photograph" and is in fact a derivative work, which would give the photographer a copyright claim as well.   • This should be turned into fair use with {{Non-free historic image}}. A deceased notable artist photographed while painting one of her works is a good candidate for a fair use rationale. De728631 (talk) 20:58, 9 October 2012 (UTC)
