Template:Non-free promotional
The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership. Lack of such evidence is grounds for deletion.
It is believed that the use of some images of promotional material to illustrate:
- the person(s), product, event, or subject in question;
- where the image is unrepeatable, i.e. a free image could not be created to replace it;
- on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation;
qualifies as fair use under Copyright law of the United States. Any other usage of this image, on Wikipedia or elsewhere, might be copyright infringement. See Wikipedia:Non-free content and Wikipedia:Publicity photos.
Additionally, the copyright holder may have granted permission for use in works such as Wikipedia. However, if they have, this permission likely does not fall under a free license.
Please note that our policy usually considers fair use images of living people that merely show what they look like to be replaceable by free-licensed images and unsuitable for the project. If this is not the case for this image, a rationale must be provided proving that the image provides information beyond simple identification or showing that this image is difficult to replace by a free-licensed equivalent. Commercial third-party reusers of this image should consider whether their use is in violation of the subject's publicity rights.
- Please add a detailed non-free use rationale for each article the image is used in, which must also declare compliance with the other parts of the non-free content criteria, as well as the source of the work and copyright information.

- This tag should only be used for images of a person, product, or event that is known to have come from a press kit or similar source, for the purpose of reuse by the media.
- Additionally, if the copyright holder has granted permission, please provide further details as to the terms.

This template should be placed in the Licensing section of non-free promotional images to identify them as such. The scope for its usage includes material that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit. In most cases, this template should not be used for promotional posters; see instructions on this below.
Usage
By default, this template automatically adds files to Category:Non-free promotional images, and also to one of its subcategories, either Category:Non-free promotional images with no terms of use or Category:Non-free promotional images with terms of use, depending on whether the parameter |1= is used with an external link to the terms of use.
If a non-free use rationale is provided on the image description page, image_has_rationale should be set to yes, and the message at the bottom of the template requesting that the uploader provide a fair use rationale will be removed. Note: A non-free use rationale is required to comply with fair use guidelines, and a non-free file lacking one may be deleted after being tagged for seven days under speedy deletion criterion F6.

The optional terms parameter may be used to supply a valid URL (including "http://") where the image's terms of use may be found. If it is not supplied, the template will read without a link to the terms of use.

The optional parameter image_is_of_living_person is available. If it is set to no, the text detailing the fair use policy as applicable to images of living persons and commercial reuse of the image is removed.

Editors have the option of putting the image into one of the appropriate sub-categories, such as Category:Non-free images of advertisements. To do so, simply pass the name of the category as the first unnamed parameter:
