- To illustrate the subject of the article, including logos and trade dress etc., as these elements are inherently copyright and cannot be replaced with free imagery. While a free image could be taken of the bottle and packaging, such an image would remain subject to copyright and it is in any case questionable whether copyright subsists in the photograph as distinct from the bottle and packaging.
- The image is used as the primary means of identification of the main subject of the article.
- The copyright holder is Luksusowa, the producer.
- The image used is low-resolution and is unlikely to compete with the copyright holder's usage of the packaging, which is to market the drink.
