This is packaging artwork for Smart Parts Impulse paintball marker. |
|---|---|
| Source |
The original media (or artwork shown) may be obtained from Smart Parts Impulse paintball marker. |
| Article | |
| Portion used |
A reasonable portion of the original artwork is used in order to avoid misrepresentation of the intended image. |
| Low resolution? |
This media is of a size and resolution sufficient for accurate identification or representation without being unnecessarily high resolution. |
| Purpose of use |
The image is used to identify Smart Parts Impulse paintball marker, a notable product or service. This media is used to help the reader identify the product, assure the readers that they have reached the right article containing critical commentary about that product, and illustrate branding associations of the product or service in a way that words alone could not convey. |
| Replaceable? |
Because it is packaging artwork there is almost certainly no free equivalent. Any substitute that is not a derivative work would fail to convey the meaning intended, would tarnish or misrepresent its image, or would fail its purpose of identification or commentary. |
| Other information |
Use of this media in the article complies with Wikipedia non-free content policy, logo guidelines, and fair use under United States copyright law as described above. |
| Fair useFair use of copyrighted material in the context of Smart Partshttp://70.231.62.181/index.php/File:SP_Impulse_box.jpgtrue | |
The image is the packaging from a Smart Parts Impulse paintball marker, and the copyright for it is most likely owned by Smart Parts. It is believed that the use of low-resolution images of product packaging constitutes fair use:
- Purpose and character of the use is for educational purposes, not to sell Impulse markers
- The photo is copyrighted
- Only the front of the box is depicted; it is at a low resolution
- Effect on the market for the image is low; it is unlikely that the use of this photo in the article will prevent people from purchasing Impulse markers. Indeed, the marker is no longer in production, so that danger is minimalized even further. If anything, providing photos of the marker will more likely than not promote further sales of the marker.
Licensing
[edit | edit source]The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership. Lack of such evidence is grounds for deletion.
It is believed that the use of some images of promotional material to illustrate:
- the person(s), product, event, or subject in question;
- where the image is unrepeatable, i.e. a free image could not be created to replace it;
- on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation;
qualifies as fair use under Copyright law of the United States. Any other usage of this image, on Wikipedia or elsewhere, might be copyright infringement. See Wikipedia:Non-free content and Wikipedia:Publicity photos.
Additionally, the copyright holder may have granted permission for use in works such as Wikipedia. However, if they have, this permission likely does not fall under a free license.
Please note that our policy usually considers fair use images of living people that merely show what they look like to be replaceable by free-licensed images and unsuitable for the project. If this is not the case for this image, a rationale must be provided proving that the image provides information beyond simple identification or showing that this image is difficult to replace by a free-licensed equivalent. Commercial third-party reusers of this image should consider whether their use is in violation of the subject's publicity rights.
