Fair use for Rex Trailer

Though this image may be subject to copyright, its use is nevertheless covered by the U.S. fair use laws because:

  1. It illustrates an educational article about the subject, providing a vital image of the physical, costumed appearance of the subject at a historical point in the past examined in the article. It shows him as he was best-known and remembered.
  2. The image is used as the primary means of visual identification, and stimulation/confirmation of the reader’s memory of the article topic, which relates to the television arts.
  3. It is of much lower resolution than the original (copies made from it would be of very inferior quality unsuitable for any commercial purpose).
  4. It is not in any way replaceable with an uncopyrighted or freely copyrighted image pertinent to the article subject, because the image is of a unique item from the subject's past. No current photo of the subject, if one could be taken, could evoke the past as accurately and fully as this image does.
