[edit | edit source]Though this image may be subject to copyright, its use is nevertheless covered by the U.S. fair use laws because:
- It illustrates an educational article about the subject, providing a vital image of the physical, costumed appearance of the subject at a historical point in the past examined in the article. It shows him as he was best-known and remembered.
- The image is used as the primary means of visual identification, and stimulation/confirmation of the reader’s memory of the article topic, which relates to the television arts.
- It is of much lower resolution than the original (copies made from it would be of very inferior quality unsuitable for any commercial purpose).
- It is not in any way replaceable with an uncopyrighted or freely copyrighted image pertinent to the article subject, because the image is of a unique item from the subject's past. No current photo of the subject, if one could be taken, could evoke the past as accurately and fully as this image does.
