[edit | edit source]Though this image is subject to copyright, its use is covered by the U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies, because:
- It illustrates an educational article about the deceased person that the photograph represents.
- The image is used as the primary means of visual identification of the article topic, and could be considered an iconic image.
- It is a low resolution image, and thus not suitable for production of counterfeit goods.
- The photo is not used in such a way that a reader would be confused into believing that the article is written or authorized by the owner of the photo.
- As the subject is deceased, the photograph is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value.
Licensing:
[edit | edit source]Please remember that the non-free content criteria require that non-free images on Wikipedia must not "[be] used in a manner that is likely to replace the original market role of the original copyrighted media." Use of historic images from press agencies must only be of a transformative nature, when the image itself is the subject of commentary rather than the event it depicts (which is the original market role, and is not allowed per policy).
