Fair use for Irving Phillips
[edit | edit source]Though this image, which I have myself scanned and adjusted for brightness and contrast from the original art for a The Strange World of Mr. Mum comic panel is subject to © by The Hall Syndicate, Inc., its use here is regardless covered by the U.S. fair use laws because:
- The panel image illustrates an educational article about the artist; its inclusion in the article adds significantly to understanding the text because it is a historical sample of Phillips' signature. Therefore the image substantially improves the educational value of the article.
- The image is used as the primary means of visual identification of the signature in the info box. It is the very thing of which we write.
- It is of lower resolution than the original. Any potential copies made from it would be of very inferior quality and unsuitable for any commercial purpose. The image is not used here for profit, and its use on Wikipedia does not compete with the copyright holder, and such use does not decrease the value of the copyright to its holder.
- It is not in any way replaceable with an uncopyrighted or freely copyrighted image pertinent to the work referenced in the article, because the whole body of work so signed under discussion in this section of the article is © The Hall Syndicate, Inc.
