While the work is copyrighted and the copyright is owned by the heirs of Konstantin Chebotarev. I believe the using of a low quality reproduction of a painting by Chebotarev in the article about its author fully qualifies as fair use as defined in the copyright law of the USA:
- The reproduction is used for critical commentary and an example of the style of the author
- The resolution is low and copies of it will be of very inferior quality
- The article is greatly improved since it provides a sample of his work
