Mr. Gilard says in his site (in French) he wants his memories and experiences to be known to the public, including the memories of his chlidhood hero - Alfred Nakache, "the swimmer from Auschwitz" as he calles him (Le "nageur d'Auschwitz").
Although the permission to use the image was not explicitly given; I presume that a low-res cropped version of the photo of would be covered by fair use for use in Alfred Nakache because Nakache is deceased, a notable person of historical importance, and no other picture is available. This rationale for fair use only for the purpose of illustrating Alfred Nakache in the article about him.

A larger and better version of this picture can be found on the owners's website. The larger version is clearly labeled as being copyrighted.
